[気を付けたほうがいいこと](https://trend.bestmatch.co.jp/ja/besttrend/article/trend/minimum-wage-2023#a03) - [正社員の場合はどうしたらいいの？](https://trend.bestmatch.co.jp/ja/besttrend/article/trend/minimum-wage-2023#a04) - [まとめ](https://trend.bestmatch.co.jp/ja/besttrend/article/trend/minimum-wage-2023#a05) ## 最低賃金とは 最低賃金制度とは、最低賃金法に基づき国が賃金の最低限度を定め、 使用者は、その最低賃金額以上の賃金を支払わなければならないとする制度です。 最低賃金の対象となるのは、実際に支払われる賃金から 一部の賃金(割増賃金、精皆勤手当、通勤手当、家族手当など)を除いた 「毎月支払われる基本的な賃金」です。 日給制や月給制の場合、最低賃金額以上となっているかどうかは 賃金額を時間当たりの金額に換算し、最低賃金（時間額）と比較します。 [【出典】厚生労働省：最低賃金制度の概要](https://www.mhlw.go.jp/www2/topics/seido/kijunkyoku/minimum/minimum-09.htm) ## 改定後（2023年10月以降）の最低賃金について ★千葉県……1026円(+42円)　 ★東京都……1113円(+41円) ★神奈川県…1112円(+41円) ★埼玉県……1028円(+41円)   ※最低賃金の引上げ額の目安は各都道府県の経済実態に応じて、 　A～Ｄの４ランクに分けて提示されています。 ▼全国のランクについては下記参照（厚生労働省ＨＰより） ![2023最低賃金ランク](https://trend.bestmatch.co.jp/hs-fs/hubfs/2023%E6%9C%80%E4%BD%8E%E8%B3%83%E9%87%91%E3%83%A9%E3%83%B3%E3%82%AF.png?width=693&height=215&name=2023%E6%9C%80%E4%BD%8E%E8%B3%83%E9%87%91%E3%83%A9%E3%83%B3%E3%82%AF.png) 今回、最低賃金（全国加重平均）の額は1,004円（昨年度961円）、 引上げ額は43円で引上げ率は4.5％と、過去最高※となりました。 ※昭和53年度に目安制度が始まって以降 [【出典】厚生労働省：令和5年度地域別最低賃金額改定の目安について](https://www.mhlw.go.jp/stf/newpage_34458.html) ## ※注意ポイント※ 最低賃金違反を防ぐために**求人情報の見直し**が必要です。 現在掲載中のホームページ情報や、求人サイトの情報など 下記3点に注意＆スケジュールを逆算して、更新漏れのないようにしましょう。   **1、試用期間や学生時給も対象です** 最低賃金は、「試用期間」や「研修期間」、「高校生などの学生時給」も例外ではありません。   “研修期間中の賃金を－50円で設定していたら、最低賃金を割っていた” 上記の場合は最低賃金違反となります。  ただし、使用者より申請のあった業種または職種の労働者の賃金水準について、 減額する合理的な理由がある場合のみ「減額特例」の許可の対象となります。 労働者が「減額特例※」が適用される期間は最長で採用から6ヶ月以内で、 特例許可申請書を都道府県労働局長へ提出し許可を受けられれば、最低賃金より20％減額した給与を支払えます。 ただし、過去の統計を見ると減額特例の申請を行った使用者はなく、労働局長からの許可も当然ありません。  ※減額特例 最低賃金の減額特例が適応される労働者は以下になります。 1.　精神又は身体の障害により著しく労働能力の低い者 2.　試の使用期間中の者 3.　職業能力開発促進法に基づく認定職業訓練を受ける者のうち一定のもの 4.　イ　軽易な業務に従事する者 5.　断続的労働に従事する者   **2、既存スタッフの給与に注意** 最低賃金に合わせて新人の給与をＵＰしたら、 「給与がほとんど変わらない」とベテランスタッフが離職…という展開も考えられます。 経験に応じて給与差を設けている場合などは あらかじめ既存の従業員たちと話し合うなど、 大きな不満に繋がらないよう事前準備を行いましょう！   **3、最低賃金法違反にはペナルティ(罰金刑)があります** 最低賃金法に違反している場合には労使契約は無効とされ、 最低賃金と同額の定めをしたものとみなされることが規定されています。  最低賃金未満の賃金しか支払っていなかった場合は、 最低賃金との差額を使用者は労働者に支払わなくてはなりません。   また、最低賃金法には罰則規定があり、 地域別最低賃金未満の場合は50万円以下の罰金、 産業別最低賃金未満の場合は30万円以下の罰金を支払うことが定められています。 ## 正社員の場合はどうしたらいいの？ 月給制の場合は、 「月給÷月平均所定労働時間≧最低賃金額」 であることが必要です。   **計算例(1)** ※月給22万円(基本給14万5000円＋職務手当3万円＋時間外手当3万5000円＋通勤手当1万円)の場合 →年間所定労働日数250日(年間休日115日)・1日の所定労働時間は8時間 ■千葉県最低賃金：1026円 (A)最低賃金の対象となる金額 この場合は時間外手当と通勤手当が対象外となりますので、 22万円―(3万5000円＋1万円)＝17万5000円 (B)最低賃金の算出方法 (17万5000円×12ヵ月)÷(250日×8時間)＝1050円 ★1時間あたり1050円＞千葉県最低賃金1026円　のため「**最低賃金以上**」となります   **計算例(2)** ※月給20万円(基本給12万5000円＋職務手当3万円＋時間外手当3万5000円＋通勤手当1万円)の場合 →年間所定労働日数250日(年間休日115日)・1日の所定労働時間は8時間 ■千葉県最低賃金：1026円 (A)最低賃金の対象となる金額 この場合は時間外手当と通勤手当が対象外となりますので、 20万円―(35000円＋10000円)＝15万5000円 (B)最低賃金の算出方法 (15万5000円×12ヵ月)÷(250日×8時間)＝930円 ★1時間あたり930円＞千葉県最低賃金1026円　のため「**最低賃金以下**」となります [【出典（参考）】厚生労働省：最低賃金額以上かどうかを確認する方法](https://www.mhlw.go.jp/www2/topics/seido/kijunkyoku/minimum/minimum-13.htm) ## まとめ 昨年に続き、3年連続で過去最高の引き上げ額となりました。 最低賃金に合わせた給与改定だけではなく、 全体の引き上げに合わせて更に給与を高くする動きも見られます。 最低賃金に合わせて給与以外の打ち出し方や近隣の動きなど 気になることやお困りごとがありましたら、ぜひお気軽にご相談ください。 地域の担当としてしっかりとサポートさせていただきます。       -
